Terms of Service

1. Seller and contact details

TimeTool is a product supplied by RUBINO LORENZO, an Italian sole proprietorship registered with the Bologna Business Register and presented publicly under the trading name MotorsportSoftware.com.

In these Terms, “TimeTool”, “we”, “us”, and “our” refer to that business. “You” means the person or business using the service.

2. The service

TimeTool is schedule-management software for creating, importing, synchronizing, sharing, and following event schedules. Depending on the account and plan, it can include shared streams, private events, notifications, Live Activities, and AI-assisted extraction of schedule data from compatible PDF files.

TimeTool is an organizational aid. It is not an official timing system, race-control system, emergency service, or safety-critical system. You must verify critical times and instructions against the organizer's official information.

3. Accounts and eligibility

• You must provide accurate account and billing information and keep access credentials secure.
• You must have legal capacity to enter a contract. If you act for an organization, you confirm that you are authorized to bind it.
• Paid access belongs to the purchasing TimeTool account. Team access may be granted only through the product's supported membership tools.
• You are responsible for activity performed through your account unless caused by a failure for which we are responsible.

4. Plans and VAT-inclusive prices

All displayed prices include VAT or equivalent indirect tax where applicable. Stripe determines the tax included in the displayed total from the billing information collected at checkout. Your bank or payment provider may separately charge currency-conversion or payment fees; those charges are not imposed by TimeTool.

Annual introductory offer

An eligible customer with no previous paid TimeTool membership may receive the first annual term for USD 14.99. The offer applies once, must be redeemed by 31 December 2026 at 23:59 Europe/Rome, and is subject to the eligibility shown at checkout. Unless cancelled, renewal is at the then-disclosed standard annual price, currently USD 29.99 VAT inclusive.

5. Ordering and contract formation

Paid website orders are processed on Stripe Checkout. Before paying, Stripe shows the selected product, tax-inclusive total, billing frequency, payment method, and a required checkbox for these Terms. The contract is concluded when Stripe confirms payment or, for an asynchronous payment method, when payment later succeeds.

The checkout confirmation and Stripe receipt are the durable confirmation of your order. Keep a copy of these Terms and the receipt for your records.

6. Immediate supply

By accepting these Terms at checkout, you expressly request that paid access or the purchased extraction entitlement be made available immediately, before the 14-day withdrawal period ends.

For an Extra PDF Extraction, you also acknowledge that if you choose to consume the entitlement within that period and the one-time digital service is fully performed, your statutory right of withdrawal for that completed service may end. This does not remove rights that cannot legally be waived.

7. Renewal and cancellation

• Member Monthly renews each month; Member Annual renews each year.
• Stripe charges the saved payment method at the start of each renewal period.
• You can cancel a website subscription from Manage Stripe Billing in TimeTool. Cancellation normally takes effect at the end of the paid period, so access continues until then.
• Cancellation stops future renewal; it is separate from the statutory right of withdrawal and does not itself create a retroactive refund.
• If a payment fails, paid access may be suspended or end after Stripe's retry process.

Subscriptions bought in the iOS app are governed and managed through Apple's App Store. Website Stripe billing cannot cancel an App Store subscription.

8. Consumer withdrawal rights

If you are an EU/EEA consumer, you normally have 14 days from conclusion of an online service contract to withdraw without giving a reason. Send an unambiguous statement to [email protected] before the deadline. You may use the model form below, but it is not mandatory.

Because you request immediate supply at checkout, if you withdraw after the subscription service has started, we may deduct or request an amount proportionate to the service supplied before your notice. For a one-time digital service that you expressly requested immediately and that has already been fully performed, the withdrawal right may no longer apply after your acknowledgement at checkout.

When withdrawal applies, we will reimburse the amount due without undue delay and no later than 14 days after receiving the notice, using the original payment method unless agreed otherwise. These rules do not limit more favorable mandatory rights under the law applicable to you.

9. Refunds, conformity, and legal guarantee

Your mandatory consumer rights remain in force. Digital services must conform to the contract and work as described. If a paid feature is defective, contact support with enough information to investigate. Where required by law, we will restore conformity within a reasonable time and without charge; if that is not possible, you may be entitled to a price reduction or to terminate the contract and receive the corresponding refund.

Outside statutory withdrawal, conformity, duplicate-charge, or other mandatory rights, completed billing periods and consumed PDF extractions are not normally refundable. This sentence does not exclude any right that applicable law gives you.

10. Acceptable use

You must not misuse the service, interfere with its security or operation, attempt unauthorized access, resell access outside supported team tools, upload unlawful material, or use the service to infringe another person's rights. PDF extraction is intended for timetable and schedule documents; avoid uploading unnecessary personal or confidential data.

11. Service availability and changes

We may maintain, secure, or improve the service and may change non-essential features. We do not promise uninterrupted availability. For material changes that negatively affect a paid continuous service, we will provide reasonable advance information where required and preserve any mandatory right to terminate.

We may change future subscription prices only prospectively. Existing subscribers will receive the notice required by applicable law before a new price applies and may cancel before renewal.

12. Responsibility

Nothing in these Terms excludes liability or remedies that cannot lawfully be excluded, including mandatory consumer rights. To the extent permitted by law, we are not responsible for losses caused by inaccurate third-party schedule data, unsupported files, failures outside our reasonable control, or use of TimeTool as a safety-critical or official timing source.

13. Privacy and payments

Our Privacy Notice explains how TimeTool processes personal data. Stripe processes payment, billing-address, tax, and payment-method information under its own privacy terms and supplies TimeTool with transaction and subscription records needed to provide paid access, prevent fraud, handle refunds, and meet accounting and tax obligations. TimeTool does not receive full card details.

14. Account closure

You can delete your TimeTool account from the app. Account deletion and subscription cancellation are separate operations. Cancel a recurring Stripe or App Store subscription before deleting the account, or contact support so the billing relationship can be handled correctly. Deleting the app from a device does not cancel a subscription.

We may suspend or terminate an account for serious or repeated breach, fraud, security risk, or legal necessity. When consumer law requires it, we will provide notice and preserve access to remedies.

15. Governing law and disputes

These Terms are governed by Italian law. If you are a consumer, this choice does not deprive you of mandatory protection granted by the law of your country of habitual residence, and you may bring proceedings in any court available to you under mandatory consumer jurisdiction rules.

Please send complaints first to [email protected]. Consumers may also seek assistance from the European Consumer Centre in their country or use any competent consumer alternative-dispute-resolution body.

16. Changes to these Terms

The version accepted at checkout governs that purchase. We may update these Terms for future purchases or for justified legal, security, or service changes. Material changes to an active subscription will be communicated as required by law. The effective date and version appear at the top of this page.
